Terms of UseThis Terms of Use document (hereinafter referred to as the "Terms") governs the service provided by Fusion Inc. (hereinafter referred to as the "Company") through its Internet platform (hereinafter referred to as the "Service"). All users of this Service (hereinafter referred to as "customers") agree to use the Service in accordance with these Terms.
Article 1: Customer Qualifications- Customers may use the Service in accordance with these Terms. However, membership registration is required for customers to purchase products through this Service.
- The Company may suspend a customer's use of the Service or deny applications if the customer falls under any of the following conditions:
- a. The customer does not exist.
- b. The customer's membership is suspended or has been canceled in the past.
- c. False, erroneous, or incomplete information was provided at the time of registration or use.
- d. The customer has failed to make payments to the Company.
- e. The customer's actions interfere with the Company's business operations or technical systems.
- f. The customer disrupts or interferes with other customers' use of the Service.
- g. A minor uses the Service without parental consent.
- h. The customer resides outside Japan.
- i. The customer has previously violated these Terms or other Company terms.
- j. Other cases deemed inappropriate by the Company.
Article 2: Delivery of Products- Products and other deliverables (hereinafter referred to as "delivery items") shall only be delivered to addresses within Japan. Certain areas may be excluded from delivery.
- Customers may not change the delivery address unless a request is submitted in accordance with the Company's prescribed method.
- Items will be delivered by a contracted delivery company under its responsibility, except for certain areas. Delivery terms will follow the delivery company's policies.
- Customers are responsible for shipping charges unless otherwise indicated on the product's page.
Article 3: Information ProvisionCustomers agree to the display of advertisements and banners across all content, including websites and emails. Customers also consent to receiving product information, advertisements, and other communications from the Company via email, direct mail, or similar methods.
Article 4: Intellectual Property RightsThe copyrights and other intellectual property rights for product images and other content provided by the Service belong to the Company or legitimate rights holders. Customers may not reproduce, reprint, modify, or use this content for secondary purposes without prior authorization.
Article 5: Prohibited ActivitiesCustomers shall not engage in the following activities when using the Service:
- Violating laws or public order and morals.
- Engaging in criminal activities.
- Infringing on copyrights, trademarks, or other intellectual property rights.
- Destroying or interfering with the Company's servers or networks.
- Commercially exploiting information obtained through the Service.
- Interfering with the operation of the Service.
- Attempting unauthorized access.
- Collecting or accumulating personal information about other customers.
- Impersonating other customers.
- Providing benefits to antisocial forces in connection with the Service.
- Other actions deemed inappropriate by the Company.
Article 6: Suspension of Service- The Company may suspend or discontinue the Service without prior notice if any of the following conditions arise:
- a. System maintenance or updates are required.
- b. Force majeure events such as earthquakes, lightning strikes, fires, power outages, or natural disasters make Service provision difficult.
- c. Computer or communication line issues occur due to accidents.
- d. Other situations where the Company deems it difficult to provide the Service.
- The Company shall not be held liable for any disadvantages or damages incurred by customers or third parties due to the suspension or discontinuation of the Service.
Article 7: Restrictions and Termination- The Company may restrict or terminate a customer's use of the Service without prior notice if:
- a. The customer violates these Terms.
- b. False information is found in the customer's registration.
- c. The customer's reported payment method (e.g., credit card) is suspended.
- d. The customer defaults on payment obligations.
- e. The customer fails to respond to Company communications for a specified period.
- f. The Service has not been used for an extended period.
- g. The Company deems the customer's use of the Service inappropriate.
Article 8: Disclaimers- The Company does not guarantee the safety, reliability, accuracy, completeness, or suitability of the Service for specific purposes.
- The Company is not responsible for damages arising from the use of the Service unless stipulated by the Consumer Contract Act.
- Customers are responsible for compliance with local laws regarding the receipt, possession, use, and sale of purchased items.
- Customers must ensure that items purchased can be lawfully imported into their country.
Article 9: Changes to the ServiceThe Company reserves the right to change or discontinue the Service without notifying customers. The Company shall not be held liable for any damages incurred as a result.
Article 10: Changes to Terms of UseThe Company may modify these Terms at any time without prior notice. Continued use of the Service constitutes acceptance of the modified Terms.
Article 11: Personal InformationThe Company handles personal information in accordance with its Privacy Policy.
Article 12: NotificationsNotifications from the Company will be sent to the customer's registered contact details. Customers are responsible for keeping their contact information up to date.
Article 13: Transfer of RightsCustomers may not transfer their rights or obligations under these Terms to a third party without prior written consent from the Company.
Article 14: Governing Law and Jurisdiction- These Terms are governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
- Any disputes arising from the Service will be resolved in the court of jurisdiction where the Company's headquarters is located.
